Back in 2009, Robert Bickham, a broker for UBS, found himself in a bit of a pickle: he was identified in a client complaint against UBS, but had never uttered a word of investment or other financial advice to the client who made the complaint.

Despite this, Bickham wound up with a blot on his record—the customer arbitration against UBS found its way onto his previously squeaky clean Central Registration Depository record (CRD).

Seeking to clear his name, Bickham had recourse to FINRA, which decided in his favour. In it’s decision the arbitrator confirmed Bickham’s claim that he had nothing to do with the original claimants against UBS: “[Bickham had] [n]ever spoken or met with any of the Claimants in the underlying case, FINRA Case No. 09-03723 (Bishop), regarding their overall or specific financial situation or investments and that he never served as their invest representative.”
